Category

Incorporate / Name / Trademark

Start with the name and the filing order. Many solo wellness businesses begin as a Florida LLC, so the first move is to search the name on Sunbiz, choose the structure, and file correctly with the Florida Division of Corporations before you spend money on branding. If you plan to build a long-term brand, check the trademark side before you invest in marketing.

  • Search Sunbiz first to make sure the name is distinguishable and decide whether you are forming an LLC, a corporation, or operating as a sole proprietor.
  • If you are forming an LLC, file the Articles of Organization through Sunbiz. The current new Florida LLC filing fee is $125.
  • If the public-facing name is different from the legal owner or entity name, file a Florida fictitious name as well.
  • Search the USPTO before you spend money on a logo, uniforms, packaging, or storefront graphics.
  • After the name is cleared, secure the matching domain, professional email, and social handles so everything points to the same brand.
Do not build your brand around a name until the Sunbiz filing path and trademark checks are done.

EIN / Operating Agreement / Banking

After the Sunbiz filing is complete, set up the tax and money side correctly. Your EIN comes from the IRS and is what many banks and local tax applications want to see. This is also the stage where you document how the LLC operates, separate business spending from personal spending, and build a real startup budget.

  • Apply for an EIN through the IRS after your business is registered, then save the confirmation notice with your records.
  • Create an operating agreement, even for a one-member LLC, so ownership, money handling, and decision-making are documented.
  • Open a business checking account using your EIN, formation documents, ID, and ownership or operating documents. Many banks also ask for your business license information when it applies.
  • List startup costs by category: filing fees, insurance, room rent, equipment, linens, products, software, payment fees, and marketing.
  • Track receipts, mileage, product usage, rent, utilities, software, and marketing so you know your real gross profit and net profit.
  • File the Florida annual report every year to keep the LLC active and avoid late fees or administrative dissolution.
Many single-member LLCs are reported on the owner's federal return unless another tax election is made, but tax treatment varies. Keep clean books and confirm your setup with a qualified tax professional.

Licenses / Compliance / Insurance

Before your first paid appointment, make sure the business can legally operate at that location in Florida and in Polk County. Establishment licensing, local business tax receipts, sales-tax registration when you sell retail, insurance, sanitation, and scope boundaries all need to be ready before you start selling appointments.

  • If you are opening your own massage location, apply for a Florida massage establishment license for that specific location. Review the ownership-entity requirements early and make sure the Sunbiz filing is correct before you apply.
  • If you are opening your own facial specialist or esthetics location, obtain a Florida cosmetology salon license. DBPR states the salon license must be issued and available for posting before the salon can open.
  • If you are planning a home salon, the salon area must be separated from living quarters by a permanent wall, have a separate entrance, and have separate toilet and lavatory access from the salon side. Local building, fire, zoning, HOA, and insurance rules still matter.
  • Apply for a Polk County local business tax receipt. If your address is inside city limits, check city requirements too. Lakeland, for example, requires both a city receipt and a Polk County receipt.
  • If you sell retail skincare or other taxable goods, register with the Florida Department of Revenue to collect and remit sales tax before you begin doing business.
  • Carry professional liability coverage before you perform paid services. If you have a room, equipment, or inventory, review whether general liability, property coverage, or a business owners policy makes sense. If you hire employees, review workers' compensation requirements.
  • Prepare intake, contraindication, consent, incident, and aftercare forms that match the actual services you offer.
  • Stay inside your Florida license scope and refer out when a request falls outside training, licensure, or safe practice.
Do not assume the LLC filing alone gives you permission to open. The entity filing, establishment license, local receipts, and tax registrations are separate steps.

  • Use Facebook for business details, updates, and local credibility; use Instagram for portfolio, highlights, and before-and-after content with consent; use TikTok for short educational videos, treatment-room clips, and personality-driven discovery.
  • Upload real photos and short videos of the treatment space, front entry, services, and brand style so clients know what to expect before they book.
  • Use original copy, descriptive internal links, and consistent business name, address, phone, and booking details anywhere your business appears online.
Do not rely on a personal profile to carry the business. Build branded business profiles that match your website, booking page, and Google listing.

Should I open right away or work for someone first?

Usually the best answer is to start where the learning curve is safest. Many Preserva graduates benefit from working in a spa, clinic, or employer setting first while they refine treatment flow, client retention, and pricing discipline. Then they move into room rental, a suite, or a solo brand with much better systems.

What do I need before I see my first paying client?

At minimum: the correct Florida-facing legal setup, appropriate insurance, a safe and compliant service environment, the right establishment setup for the location, intake and consent forms, a booking and payment system, and a dedicated client communication channel that is not just a personal phone and social DMs.

Do I need a full website before I start?

Not a large one. But you do need a clean mobile-friendly web presence with services, city or service-area details, booking access, and consistent business information. A complete Google Business Profile plus a simple website usually beats a flashy but unfinished launch.

What should I never copy from another business?

Do not reuse another school's copy, another spa's menu text, someone else's logo, or unlicensed photos pulled from the web. Use your own brand language, your own policies, and only original or properly licensed media. That is better legally, safer ethically, and stronger for long-term SEO.
