Terms of Use and Continuing Education Agreement

Effective date: September 3, 2026

This page contains three separate sections:

The Continuing Education Student Agreement applies only to continuing education courses. It does not replace the enrollment agreements, catalogs, refund policies, or other required disclosures for our Massage Therapy or Facial Specialist / Esthetician programs.

The Photo and Video Release requires separate acceptance. Merely visiting this website, submitting an inquiry, or agreeing to the website terms does not grant permission to use your photograph or video.


Part 1: Website Terms of Use

1. About these terms

These terms address use of preservainstitute.com, operated by Preserva Therapy Group Inc., doing business as Preserva Institute (“Preserva,” “we,” “us,” or “our”).

Please read them before using the website. If you do not agree, do not use the website; contact us by telephone or email for assistance.

Where a transaction requires your agreement, the applicable terms will be presented through that transaction process. Browsing the website does not itself enroll you, authorize a charge, release rights to your photograph, or provide consent to optional marketing or tracking.

2. Program inquiries and enrollment

Information about our school programs is available on the Massage Therapy and Facial Specialist / Esthetician pages.

Inquiry forms request information; they are not enrollment contracts or seat reservations.

Admission, enrollment, attendance, completion requirements, tuition, fees, withdrawal, cancellation, and refunds are governed by the applicable enrollment agreement, catalog, required disclosures, and law.

Continuing education courses are subject to the agreement in Part 2 and any applicable course-specific terms presented before registration. If there is a conflict about a specific enrollment or purchase, the applicable transaction-specific agreement controls to the extent permitted by law.

Prospective students under 18 should involve a parent or legal guardian. Admission age and any required signatures are determined by the applicable admissions requirements, not by a blanket website age restriction.

3. Payments, financing, and refunds

Review the total price, applicable fees, payment schedule, and cancellation or refund terms presented for your specific program or purchase before committing to payment.

We do not impose a blanket “all sales final” rule through these website terms. The continuing education refund provisions in Part 2 apply only to the continuing education registrations governed by that agreement.

Third-party financing is subject to the provider’s approval and separate terms. A financing offer does not guarantee approval or change our obligations under your school agreement.

These website terms do not authorize new charges or retroactive price changes.

4. Appropriate use

Use the website lawfully and provide accurate information when requesting services.

Do not impersonate another person, submit someone else’s information without authority, upload malicious software, attempt unauthorized access, interfere with website operation, or collect private information about others without permission.

We may take proportionate steps to address misuse or security threats. Restrictions on website access do not automatically cancel an enrollment or extinguish existing student rights.

5. Website content and intellectual property

Website text, logos, images, and other materials belong to Preserva or their respective owners.

You may view and print information for personal, noncommercial purposes, subject to applicable law. Commercial reproduction or distribution generally requires permission from the relevant rights holder. Nothing here limits fair use or other rights provided by law.

Separate course-material licenses may apply to enrolled students. Sending us a private inquiry does not transfer ownership of your personal information, photograph, or message to us.

6. Feedback, reviews, and photographs

You may share honest opinions about your experience, subject to applicable law. These terms do not prohibit lawful criticism, impose penalties for honest reviews, or require you to transfer ownership of your review.

These website terms do not grant permission to use a student’s identifiable photograph, video, or testimonial in promotional materials. Any necessary permission or release must be obtained separately.

7. Privacy and communications

Our Privacy Notice and Cookie Policy explain information practices and choices. They are disclosures, not blanket consent to every data use.

When you request information, we may respond using the contact details you provide, subject to applicable requirements.

Promotional texts, calls, and emails are subject to the relevant consent and opt-out rules. Separate permissions required for electronic signatures, record delivery, marketing, or tracking are not replaced by these terms.

8. External links and availability

External forms, payment and financing services, maps, and other linked tools may be governed by their own terms. Review those terms before providing information or completing a transaction.

We aim to provide a useful website but cannot guarantee uninterrupted or error-free access. If an interruption affects an application, payment, or deadline, contact us promptly.

Website outages do not eliminate rights or remedies available under your agreement or law.

9. Information and responsibility

Our Website Disclaimer provides additional context about program information, career outcomes, and educational content.

Nothing in these terms excuses fraud or misrepresentation, excludes liability that cannot lawfully be excluded, or waives non-waivable consumer or student rights.

10. Questions, disputes, and governing law

Please contact us with concerns so we can try to resolve them.

These website terms are governed by Florida law, subject to any mandatory protections or jurisdictional requirements that apply. Nothing here prevents a complaint to a regulator or the exercise of a legal right.

These website terms do not create a mandatory arbitration agreement, class-action waiver, shortened deadline for claims, or exclusive court venue. A separately signed agreement may address disputes; these terms do not amend it.

11. Changes

We may update website information and these terms, with the revised effective date shown above. Material changes will receive additional notice where required.

Changes do not retroactively alter completed transactions or signed enrollment agreements without a lawful basis and any required agreement.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.


Part 2: Continuing Education Student Agreement

This section applies only to continuing education courses. It does not apply to initial enrollment in the Massage Therapy or Facial Specialist / Esthetician programs.

This agreement is between the participant registering for the continuing education course identified on the registration form and Preserva Institute. It applies when presented and accepted as part of the applicable course-registration process.

1. Class times

For exact class hours, dates, and times, please refer to the course-specific information on the Preserva Institute website. This information will also be included in the confirmation letter emailed after registration.

2. Tuition and refund policy

Tuition varies for each continuing education course. Please refer to the applicable course information on the Preserva Institute website. The full amount is due at the time of registration.

If a participant withdraws more than three (3) weeks before the start of the class, the participant will be refunded their tuition by check within ten (10) business days, minus a nonrefundable administrative charge of $100.00.

No refunds will be given for participant cancellation less than three (3) weeks before the first day of class or at any time after the class has started, except where required by applicable law or the governing course-specific terms.

3. Class cancellation by Preserva Institute

If a course is cancelled by Preserva Institute because of an insufficient number of registrations, all money received will be refunded or transferred to another class, as elected by the registrant.

If a class is cancelled for another reason, such as the presenter becoming ill, a new course will be scheduled and payments will be transferred, subject to any refund or other rights required by applicable law.

4. Attendance and dismissal

Participants must be in class on time. One hundred percent attendance is expected.

Participants who miss more than two (2) hours of a Preserva Institute continuing education course will not receive a Certificate of Completion. This provision does not authorize awarding credit for missed instruction or override stricter attendance requirements imposed by the applicable licensing board or course approval.

A participant may be dismissed for insufficient progress, nonpayment of tuition, or nonattendance. Under this continuing education agreement, tuition is not refunded following dismissal, except where required by applicable law or the governing course-specific terms.

Reinstatement following dismissal is at the instructor’s discretion, subject to applicable course and regulatory requirements.

5. Certificates

To receive a Certificate of Completion, the participant must satisfy the applicable course-completion requirements, pay tuition in full, and submit all required documentation.

Preserva Institute will replace lost or damaged certificates upon request. The first replacement certificate is complimentary. Additional replacement certificates are subject to a $15.00 fee plus postage.

A Certificate of Completion documents completion of the identified course. It does not independently grant a professional license, expand a participant’s lawful scope of practice, or guarantee acceptance of credit by every licensing authority.

6. Educational use and instructor authorization

The participant acknowledges that the continuing education course provides education and training in the topic identified during registration.

Participants may share accumulated knowledge with other professionals, but course completion does not authorize them to present themselves as Preserva Institute instructors, issue Preserva Institute certifications, or reproduce and teach Preserva Institute course materials without the required authorization.

7. Course materials

Course materials are protected by copyright and other intellectual property laws. Unless otherwise stated, Preserva Institute owns the materials or uses them with permission.

Participants must not remove copyright notices or reproduce, distribute, or retransmit protected course materials, in whole or in part, without prior permission, except as permitted by law.

This restriction applies to electronic and printed materials and to distribution with or without payment. Participants must not share personal course-access credentials.

8. Relationship to other terms and legal rights

Course-specific terms presented and accepted during registration may provide additional requirements. Nothing in this agreement overrides applicable law, mandatory refund rights, licensing-board requirements, or other rights that cannot lawfully be waived.

This agreement does not replace a previously signed agreement or retroactively change an existing registration.


Part 3: Optional Photo and Video Release

Separate permission is required. This release applies only when the participant, or an authorized parent or legal guardian where required, separately signs or affirmatively accepts it through a documented process. Acceptance of the website terms or continuing education agreement alone does not activate this release.

1. Permission

By separately accepting this release, I grant Preserva Therapy Group Inc., doing business as Preserva Institute, the right and permission to use photographs and video or audio recordings of me on Preserva Institute websites and in publications, promotional flyers, educational materials, and other similar materials without compensation to me.

I understand that these materials may be published on the Internet and that I may be identified by name or title in information accompanying the materials.

2. Editing and ownership

I understand that the materials may be edited, reproduced, and distributed for the purposes described in this release. I waive the right to inspect or approve the final materials, to the extent permitted by law.

Photographs and recordings created by or for Preserva Institute, together with their reproductions and associated media files, remain the property of Preserva Institute or the applicable rights holder. This release does not transfer ownership of unrelated materials that I independently own.

3. Release of claims

To the extent permitted by law, I release Preserva Therapy Group Inc., doing business as Preserva Institute, and its officers, employees, and authorized agents from claims arising from the authorized use or distribution of the photographs and recordings described in this release.

This release does not authorize unlawful, defamatory, or misleading use and does not waive rights or liability that cannot lawfully be waived.

4. Age and authority

I confirm that I am at least eighteen (18) years old and legally able to provide this permission. If the participant is under eighteen (18), a parent or legal guardian must separately provide the required authorization on the participant’s behalf.

5. Optional participation and questions

Declining this optional release does not by itself prevent a participant from requesting program information or enrolling in a course.

For questions about a release or a request concerning future use of a photograph or recording, contact Preserva Institute. Materials already printed, distributed, or shared by third parties may not be recoverable. Applicable legal rights remain unaffected.
